Legal Terms & Conditions

Reservations & Booking

To guarantee a full service private or corporate function, 25% of the anticipated total cost is required at time of booking (unless other arrangements have been made in advance). Remaining Balance is to be paid no less than seven (7) days prior to the date of function, (unless other arrangements have been made in advance & in writing).  

Brooks & Landry Fine Catering requires that a minimum guest count is reported no less than 2 weeks prior to your event, with a maximum guest count due and must be conveyed to our office 3 days prior to your event.  Guest minimums, menu pricing, menu items, and any other services or products offered by Brooks & Landry Fine Catering are subject to change at any time, without notice, based on resources, availability and other factors. Specific guest minimums, menu prices, menu items and service/product offerings will be confirmed by a Brooks & Landry Fine Catering representative during your final consultation prior to the event.  

Form of Payments accepted: Cash, Check, PayPal, Visa, MasterCard or American Express. Additional charges will be incurred when an event time exceeds the scheduled time, additional meal service personnel, or any other goods /services.  The client may perform any alterations/revisions to said contract up to and until 14 days prior to the contracted event, excluding its cancelation, while always adhering to the provisions of our deposit refund policy.

Signature on Contract is required in order to be considered valid.

 

Price Guarantees

Prices are firm for catering events held within one year of the date of contract, unless list price/market price of items increases by greater than 10%, and any State and Government tax increases.

All food produced, and charges associated with its production, are subject to 6% state sales tax (unless you provide proof that you represent a tax exempt organization).  All full service catered events are subject to an 18% Production Fee (For clarification of this fee; refer to our FAQ page on our website).

 

Cancellations

In the event of the cancellation of your scheduled event within thirty (30) days of your booking date, your deposit will be returned-less a 25% handling charge. After thirty (30) days from the booking date- Your entire deposit is non-refundable. If the booking date occurs within thirty (30) days of your event, your deposit is non-refundable. In the event of the cancellation occurring within thirty (30) days of your booked event, you will be liable for the entire event balance.

 

Labor Policy

Brooks & Landry Fine Catering is an equal opportunity employer, and we support a fair wage for all of our independent contractors and employees.  All cooks, servers and bartenders staffed at your event are considered independent contractors and are not employees of Brooks & Landry Fine Catering.  Regardless, all Independent contractors we utilize are expected to represent our company and serve our guests  to the highest standards.  For this reason we pay higher than normal wages to ensure that our cooks and servers want to work for us over and over again.  All potential workers are screened prior to any event to ensure the standards of our company are met at all times.  Customers are given the option by our coordinators of paying our staff cash at the event, or for an added 20% labor surcharge we are happy to issue payroll checks to the staff.  Our labor surcharge offsets the added cost of payroll accounting, payroll taxes and overall insurance rates.

Cooks & Servers $35/hr, Private Chefs $75 - $100/hr, Bartenders $45/hr

 

Catering Performance

Performance of this agreement is contingent upon the ability of the Caterer to complete the same and is subject to disputes, strikes, accidents, transportation, availability of foods, beverages or supplies and other causes whether enumerated herein or not. Beyond the control of the Caterer preventing or interfering with the performance of this agreement. Caterer's liability shall be limited for any breach or non-performance of the agreement or any part thereof to the amount paid for the initial deposit. Caterer shall not be liable for damages, consequential or otherwise other than for the return of the referenced deposit. Caterer is not responsible for damage or loss of any personal property at your event premises. You are responsible for the damages, theft, breakage and/or loss at or to the premises.  Brooks & Landry Fine Catering reserves the right to obtain individual general liability event insurance, at the customers expense, to protect the assets of both Brooks & Landry Fine Catering, our vendors, event venue, our contracted customer and their guests.  

 

Food Service

Brooks & Landry Catering understands that events may take longer than scheduled, and maintains a strict policy that the client is responsible for any labor overages due to a late or delayed event.  At the discretion of Brooks & Landry Fine Catering staff, leftover cooked food may remain with clients, whereas on site refrigeration is accessible to our staff, after which the client assumes all liability resulting in failure to properly maintain safe food temp's and storage of food.

 

TAM/TIPS Bartending Service

By contracting Brooks & Landry Fine Catering Bartender Service you understand and are verifying the following.

1. I understand that Brooks & Landry Fine Catering is not licensed to sell or transport alcoholic beverages, and that all customers are required to supply any and all alcoholic beverages that are to be served at the contracted event.  

2. I understand that Brooks & Landry Fine Catering does not promote under aged drinking under any circumstance and will not serve guests under the age of 21.

3. I understand the bartending staff provided/secured by Brooks & Landry Fine Catering follow the guidelines required by TAM/TIPS certification and have the right to refuse alcohol to any guest that appears intoxicated. The host will be discreetly notified of such action and such action will be recorded by Brooks & Landry Fine Catering.

4. I agree that Brooks & Landry Fine Catering is not responsible for the conduct of guests at my event and is not liable for their actions before, during or after the time frame specified on the signed contract.

5. I verify that I have the option to allow a tip cup at my event or to not allow a tip cup. If I choose not to allow a tip cup, I will instead compensate each bartender for his/her services upon completion of event $1.00 for each guest. You must let your Event Coordinator or Catering Director know three (3) days prior to your event if you request "No tip cup" Otherwise Tip Cup will be set out on Bar/Beverage Station

 

Liability

Brooks & Landry Fine Catering reserves the right to inspect and control all functions. Waiver of Liability; the client agrees to irrevocably and unconditionally release Brooks & Landry Fine Catering from liability, claims, actions and causes of action arising out of or related to any loss, damage, illness, death or injury sustained by any participant in connections with any food, services, personnel, beverages, rental items not directly provided by Brooks & Landry Fine Catering Inc.

 

Miscellaneous Information

  • Tax Exempt Groups must supply their tax exempt certificate upon booking an event.                                                   

  • VENUE setup including rental equipment, centerpieces etc is considered a service enhancement that is available for an additional fee. Rates vary depending upon extensiveness of setup and can be discussed with our Catering Director.

  • If your event contains rental equipment (tables, chairs, linen, tents, dance floors etc). A Rental Delivery & Pickup Fee may be assessed which is the responsibility of the client to pay.

  • Cake Scoring & Plating Service is complimentary for full service events.                                                                          

  • Plated & Family Style service is available for an additional fee. Please discuss with our Catering Director or Event Coordinator .

  • Delivery/Fuel Fee is applicable on all events that are greater than 40 miles round trip from our headquarters in Allen Park, MI. Fees are $25 per vehicle or more depending upon venue proximity to our headquarters.

  • Additional Labor Fee applicable for any additional staff or extended service hours requested by client or for Tray Passed Appetizer & Drink Service. $35 hourly rate applicable for Wait staff or Non Alcohol beverage attendants, $45 for Certified Bartenders. Travel time will be assessed to the requested time frame of the above service.

  • Brooks & Landry Fine Catering offers tastings to any contracted client.  Once you feel comfortable with the vision and cost of your proposal, we welcome the opportunity to schedule your tasting.  The menu you try at your tasting will be representative of the menu you have chosen.  We offer initial tastings for $250 for up to four (4) people, and an additional $50 for each additional guest.  Tastings out of contract are available and start at $600 depending upon the menu you choose.

  • All Catering Proposals are considered proprietary information that is the sole property of Brooks & Landry Fine Catering and is only authorized to be viewed by potential clients.  It is against Brooks & Landry Fine Catering’s policies to share any proprietary information with competitors or other businesses/individuals who may potentially be considered conflict of interest.
